Terms and conditions
These terms apply when your business buys Leapr Start or Leapr Growth from us. Please read them before you pay. If anything is unclear, email hello@leapr.co.uk or book a free consultancy call.
Who we are
Leapr is the trading name of Leapr Limited, a company registered in England and Wales, company number 17512642. Our registered office is 152 Barnsbridge Grove, Barnsley, S70 3RW. We are registered with the ICO under reference ZC278683. You can reach us at hello@leapr.co.uk.
In these terms, “we” and “us” mean Leapr Limited, and “you” means the business buying from us.
About these terms
We sell only to businesses. Before you pay, you confirm in a separate box at checkout that you are buying wholly or mainly for your business, not as a consumer. If you are not buying for a business, please don’t go ahead.
Because you buy as a business, the cancellation rights that the law gives consumers don’t apply. We still aim to be fair and clear, with nothing hidden.
Your agreement with us is made up of these terms and your order. For Leapr Growth, it also includes the written proposal you accept. If your proposal and these terms disagree, your proposal wins on scope, price, payment dates, minimum term, and any offer, trial or guarantee it sets out. These terms win on everything else.
For Leapr Start, your order is the plan and the payment option you choose at checkout. We save it with the version of these terms you agreed to and the date and time you agreed. Your agreement starts when you submit your Direct Debit payment at checkout. For Leapr Growth, it starts when you accept your proposal.
If you agree on behalf of a company, you confirm that you are allowed to do so.
Sections whose heading starts with “Leapr Start” apply only to Leapr Start. Everything else applies to both Leapr Start and Leapr Growth, except where a sentence says it is only for one of them.
Leapr Start: plans and prices
Leapr Start is our website service for people who work for themselves. It has three plans:
- Start Lite: one page, with 1 round of changes a month.
- Start: up to 5 pages, with 2 rounds of changes a month, your Google Business Profile set up and a new blog article every month.
- Start Plus: up to 10 pages, with 4 rounds of changes a month, service and area pages, a new blog article every week, and automatic follow ups and review requests.
Every plan includes a design from our gallery, fitted to your business, and your domain registered in your name. It also includes hosting, security and backups, and enquiries sent to your email or WhatsApp. You also get an automatic reply to each enquiry, a mini CRM with your enquiries in your account, and a dashboard with your statistics.
The full list of what each plan includes, and the prices, are on our pricing page. The price you pay is the one shown at checkout and saved with your order.
Visitor statistics that use cookies switch on only once you have confirmed your ICO status, and only for visitors who accept cookies.
Your website also comes with a privacy notice, a cookie policy, terms, a 404 page and a cookie banner. These don’t count towards the pages in your plan. These legal pages and the banner text are general templates written by us. You must check that they fit your business. They are not legal advice.
Leapr Start: how you order
- Choose a plan and how you want to pay on our pricing page.
- Create your account and answer a short questionnaire about your business.
- See your free preview and choose a design.
- At checkout, check your plan, what you pay today and what you pay later. Tick the box to agree to these terms, and the separate box to confirm you are buying for your business.
- Press Pay and start, then set up your Direct Debit on Stripe’s secure page.
Until you press Pay and start, you can change your plan or how you pay, or go back to your account to correct your answers. On Stripe’s page, you can check and correct your bank details before you confirm.
We confirm your order by email, at the latest when your payment has gone through. Your order and the version of these terms you agreed to are saved in your account.
These terms and your agreement with us are in English.
Leapr Start: building your website
Before you pay, you can see a free preview of your home page. The preview design and its sample text stay ours unless you go ahead with a plan.
After you pay, you add your photos and details in your account, whenever suits you. We write your text and build your website, starting from the design you chose.
Your first draft is ready within 5 working days of having your photos and details, and within 10 working days at the latest. If you haven’t sent your photos yet, we can use stock photos for now and replace them when yours arrive.
You check the draft on your phone or computer and send us your changes. Your plan includes 2 rounds of changes before launch, separate from your monthly rounds.
Nothing goes live until you approve it. Your website goes live on the day we publish it after your approval.
If you cancel before your website goes live, tell us by email. The setup fee covers work we start straight away, so it isn’t refunded. If you paid once for 12 months, we refund what you paid, less an amount equal to the setup fee on our pricing page.
We can keep to these times only if you send what we ask for and answer our questions. If we are waiting for you, we will remind you, and our dates move by the time we wait.
Payment
We take payments through our payment provider, Stripe, by Direct Debit. On a monthly plan, you set up a Direct Debit mandate on Stripe’s secure page for the setup fee and your monthly payments. If you pay once, the Direct Debit is for that single payment only, and we can’t take later payments from it. Stripe’s page shows the Direct Debit Guarantee.
On a monthly plan, you pay the setup fee when you pay at checkout. Your monthly payments start on the day your website goes live, and are taken each month after that.
If you choose to pay once, you make one payment for 12 months at checkout, with no setup fee. Your 12 months start on the day your website goes live. Paying once is not a subscription that renews. A pay once payment isn’t refunded after your website goes live, unless we are at fault.
New pages and other new work are quoted before we start, and you pay for them as the quote says. You receive an invoice or a receipt for each payment.
We are not registered for VAT, so our prices include no VAT. If we register for VAT, we won’t add VAT during your minimum term. After it, we will give you at least 30 days’ notice before we start adding VAT.
On Leapr Start, if a payment fails, we will tell you and try again. If it is still unpaid after 15 days, we may pause our work on your website. We will give you 7 days’ written notice before we take your website offline. If it is still unpaid after 30 days, we may end your plan. Anything already owed stays owed, including the rest of your 12 month minimum.
On a monthly plan, cancelling your Direct Debit mandate doesn’t end your plan. To end it, give notice as these terms describe.
Leapr Start: minimum term and after 12 months
Monthly plans have a 12 month minimum. It starts on the day your website goes live, not on the day you pay. We will remind you about a month before it ends.
After the 12 months, your plan carries on month to month. You can end it at any time by giving us 30 days’ notice by email. You can also give notice during your minimum, so that your plan ends when the minimum ends.
If you paid once, your plan covers 12 months from the day your website goes live. About a month before they end, we will remind you and offer you a plan to keep working with us. This is an offer, not a renewal notice.
We will not take another payment unless you choose a plan and agree to it, and you won’t move to a monthly plan automatically. If you don’t choose a plan, your plan ends when the 12 months end. You keep your website, with the same permanent licence and handover as a monthly client after the minimum, as described in Leaving and handover.
If you want to change your plan, ask us. We will tell you what changes, and from when, before anything changes.
Leapr Start: keeping your website up to date
Every month your plan includes rounds of changes: 1 round a month on Start Lite, 2 on Start and 4 on Start Plus. A round is one request with as many changes as you like to the text and images on your existing pages.
That covers things like prices, opening hours, services, offers, photos, testimonials, FAQs, links, contact details and the company details on your legal pages. On Start and Start Plus, it also covers your Google Business Profile details.
Send a round whenever you like and tell us exactly what to change. We make each round within 5 working days. Unused rounds don’t carry over. Fixing anything that stops working, or any mistake of ours, never counts as a round.
Anything new is quoted before we start, so you know the price first. New work includes new pages, new sections, a redesign and new features, such as online booking, payments or a shop. It also includes new forms, integrations, extra blog posts, logo and branding, photography, video, ads and social media.
Each extra page beyond your plan has a fixed price, paid once, shown on our pricing page.
On Start and Start Plus, we write your blog articles. You approve every article before it goes live, and we don’t publish an article you haven’t approved.
We reply to support requests by email within 3 working days on Start Lite and Start, and within 24 hours, Monday to Friday, on Start Plus. Hosting, security updates and backups are included, and we fix anything that stops working.
We work to keep your website online, but we can’t promise it will never be unavailable, for example during maintenance or a fault at our hosting provider.
Your content and your responsibilities
You are responsible for the content you send us, such as text, photos, logos and reviews. You confirm that you own it or have permission to use it, and that it is accurate and lawful.
Please check your website before you approve it, including your prices, contact details and any claims about your business. Only publish reviews and claims you can back up.
You are responsible for your own legal duties as a business. These include your privacy notice, the ICO data protection fee if you need to pay it, and any rules for your trade.
Please don’t ask us to publish anything unlawful, misleading or harmful. We may refuse it or remove it.
If you give us access to an account, such as your Google Business Profile, we use it only to provide our service. You can remove our access at any time.
Who owns what
Your content stays yours: your text, photos, logo and the enquiries you receive. You give us permission to use it only to build and run your website and to provide our service.
Our templates, tools and platform stay ours. That includes our designs, the code that builds your website, the dashboard, the editor and the CRM.
While your plan is active, you use your website as part of our service. Once you have paid for your 12 month minimum, or for your 12 months if you paid once, you get a permanent licence to keep using the website we built for you, wherever it is hosted.
The licence covers your website as it is when you leave. It doesn’t let you reuse our templates, tools or platform on their own or for other websites.
The small “Built by Leapr” credit stays in the footer of your website, including after you leave. Keeping it is a condition of the licence.
You also get this licence if you end the agreement because we seriously broke these terms, or if we end it for any reason other than your breach or non payment.
Stock photos, fonts and other items made by others are used under their own licences. We give you a list of them when you leave.
Your domain
Your domain is registered in your name and is always yours, even while we look after it.
If you already have a domain, it stays where it is. We connect it to your website with your help, or with the help of whoever manages it for you.
For a domain we register for you, the yearly renewal is included while your plan is active. When you leave, we move your domain to you, as described in Leaving and handover.
Leaving and handover
To leave, email us at hello@leapr.co.uk and give us 30 days’ notice. After your 12 month minimum, leaving costs nothing extra and you keep your website.
Monthly plans have a 12 month minimum because the setup fee doesn’t cover the cost of building your website. We recover it over the 12 months. If you leave before the minimum ends, you pay the monthly price for the months left, in one payment. Once that is paid, you have paid for your minimum, so you get the full handover and the licence to keep your website, exactly as if you had stayed to the end.
If you paid once, nothing more is owed.
The handover includes:
- your website as static files in a ZIP, which work on any hosting;
- your domain moved to you: for a .co.uk domain we change its IPS tag, and for a .com domain we give you the transfer code;
- your forms rebuilt to work without our server, using a form service or email;
- a CSV export of your enquiries, plus a summary of your traffic;
- a list of the licences for the fonts, photos and designs on your website.
After the handover, we delete your data from our systems within 30 days, and from our backups within a further 14 days, unless the law requires us to keep it. We keep our own records of what you paid us.
Setting up your new hosting is not included in the handover, but we can quote to help with it. Once your plan ends, we stop hosting your website, and new enquiries no longer reach your Leapr account.
Leapr Growth
Leapr Growth is for established businesses and bigger projects, such as custom websites, a CRM, automation and AI.
We start with a free consultancy call. If it makes sense to work together, we send you a written proposal with the scope, prices and timings. Our work starts once you accept it.
Leapr Growth has a setup fee and a monthly fee, as set out in your proposal. Your proposal also says when each one is paid.
Your proposal may include a founding client offer, such as a lower price or a free first period. Any such offer applies only as written in your proposal, including when it ends and the price after it. If your proposal gives you a founding client price, you keep it for 12 months from your first payment, then the standard price in your proposal applies. If your proposal includes a free period, you can end the agreement during it by email and pay nothing.
Leapr Growth has a minimum term of 6 months, unless your proposal says otherwise. Your proposal says when it starts. After that, it carries on month to month, and you can end it by giving us 30 days’ notice.
Payments for Leapr Growth are taken by Direct Debit, and you set up the mandate before we start. If a payment isn’t made, we may pause the service after 15 days and end the agreement after 30 days. If we end it for this reason, the rest of your minimum term stays payable.
Any guarantee, trial or delivery promise applies only as written in your proposal.
You can send change requests at any time, day or night, through your CRM or on WhatsApp. We confirm each request when it arrives. We aim to make simple changes, such as text, prices, opening hours and rules, straight away. We aim to make more complex changes on the same working day. A fault that stops your service always comes first.
Your data stays yours, and you can export it at any time. Accounts in your name, such as your domain, your WhatsApp Business account and your accounting software, always stay yours. Your proposal says what else you keep when you leave, such as your website.
If your proposal includes review calls, or asks to feature your business in our marketing, it says what you agree to. We never publish your name or your figures without your written consent.
How we handle your customers’ data
When we run your website forms, your mini CRM or a Leapr Growth service, we handle personal data about your customers and enquirers for you. For that data, you are the controller and we are the processor. This section is our data processing agreement under Article 28 of the UK GDPR.
For your own details as our customer, we are the controller, as our privacy notice explains. Both of us will comply with the UK GDPR and the Data Protection Act 2018.
What we do for you
- We handle the data only on your documented instructions: these terms, your proposal and the settings you choose in your account. If the law requires something else, we tell you first, unless the law forbids it.
- We tell you straight away if we think an instruction breaks data protection law.
- Everyone who handles the data is bound by confidentiality.
- We keep the data secure, using the measures listed below.
- We help you answer people who use their data rights, for example by exporting or deleting their records.
- We help you, as far as we reasonably can, with security, breach reports, data protection impact assessments and any consultation with the ICO.
- We tell you without undue delay, and within 48 hours at the latest, after we become aware of a personal data breach affecting your data.
- When our service ends, we return your data as an export if you ask, and then delete it within 30 days, and from our backups within a further 14 days, unless the law requires us to keep it.
- We give you the information you need to show that we keep to this section. We allow audits by you or an auditor you appoint, on reasonable notice and at your cost.
- To suggest actions to you, we use counts and totals from your enquiries, such as how many ask for each service. We don’t use the personal details in them for our own purposes.
Subprocessors
You give us general permission to use subprocessors. Today they are:
- our hosting partner, ETOMM DROPSALE S.R.L. (NextBuilders AI) in Romania, which runs our servers at OVHcloud in the UK.
- Resend, which sends our emails. It also receives the emails your customers send to the addresses we give you, and keeps them for 30 days.
- for the Leapr CRM, the providers of the accounts you choose to connect: Google (Gmail and Google Calendar), Microsoft (Outlook) and Meta (Facebook, Instagram and WhatsApp).
- Twilio, for text messages and phone calls.
- ElevenLabs, for the AI receptionist that answers your calls.
On your website, WhatsApp works through links that open your visitor’s own WhatsApp app. For Leapr Start, we don’t send or read WhatsApp messages. If you connect your WhatsApp Business number to the Leapr CRM, we send and receive messages for you through Meta.
For Leapr Growth, your proposal lists any others your service needs, such as AI, phone, messaging, payment or accounting providers.
We give you at least 30 days’ notice of any new or replacement subprocessor. You can object on reasonable data protection grounds. If we can’t agree, you can end the affected part of the service.
Each subprocessor is bound by data protection terms that protect your data as this section does. We remain responsible to you for their work.
Transfers outside the UK
Some subprocessors handle data outside the UK. Our hosting partner is in Romania, in the European Economic Area, so its access is covered by the UK adequacy regulations for the EEA. Resend is based in the United States and is certified under the UK Extension to the Data Privacy Framework, which UK law recognises as giving adequate protection. Google, Microsoft, Meta, Twilio and ElevenLabs may handle data in the United States. Where a provider is certified under the UK Extension to the Data Privacy Framework, we rely on that. For any other provider outside the UK, we use the UK International Data Transfer Agreement or the UK Addendum to the EU standard contractual clauses.
AI and your data
Where we use AI to draft replies, quotes or summaries, your data is not used to train or improve any AI model shared with other customers. Messages from your customers are treated as information, never as instructions to the AI.
Anything we send to your customers in your name that involves money or a commitment waits for your approval, as set in your account. In the first two weeks of Leapr Growth, every reply waits for your approval.
Your responsibilities as controller
You are responsible for having a lawful basis for the data. You are also responsible for your own privacy notice and other notices to your customers, such as telling callers when calls are recorded. The instructions, prices and rules you give us are your responsibility too.
Details of the processing
- What it covers: receiving, storing, organising, answering and analysing enquiries and customer records. For Leapr Growth, it also covers the tasks in your proposal, such as bookings, quotes, invoices, reminders, call answering and reports.
- How long: for as long as we provide the service, plus up to 30 days to return and delete the data.
- Types of data: names, contact details, addresses and postcodes, the content of messages and calls, call recordings and transcripts, photos sent to you, and job, quote, invoice and payment details. We never hold card numbers.
- Special category data: not intended. If a customer volunteers it, for example health details in a message, we protect it in the same way and delete it with the record.
- Whose data: your customers and enquirers, and your staff who use the system.
- How long you keep it: as you tell us, within the time your service lasts.
Security
- A separate store of data for each business, with access checked against your account every time.
- Encrypted connections to our websites and systems.
- Access to our server only with an SSH key, never a password.
- Deleted data overwritten, so it can’t be read back.
- A log of who did what in your CRM.
The limits in Our liability also apply to this section, except where the law doesn’t allow a limit.
Our liability
We provide our services with reasonable care and skill.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit.
We are not liable for loss of profit, loss of business, loss of revenue or goodwill, or any indirect or consequential loss.
Our total liability to you under or in connection with your agreement is limited to the greater of the amount you paid us in the 12 months before the event that caused the claim, or five hundred pounds.
We are not responsible for problems caused by content or instructions you give us, by your other providers, or by events outside our reasonable control.
If someone makes a claim against us because content you gave us breaks the law or their rights, you will cover our reasonable costs of dealing with it.
Ending the agreement
You can end your plan by giving notice, as described in Minimum term and after 12 months, Leaving and handover and Leapr Growth.
Either of us can end the agreement straight away by email if the other seriously breaks these terms and doesn’t put it right within 14 days of being asked. Either of us can also end it if the other becomes insolvent.
If you end the agreement because we seriously broke these terms, you don’t pay for the rest of your minimum term.
We may also pause or end our service if you ask us to publish something unlawful, or use our service to harm others.
When the agreement ends, anything already owed stays owed, and the handover in Leaving and handover applies. The sections on ownership, data, liability and governing law keep applying after the agreement ends.
For Leapr Growth, your proposal says what you keep and how we hand it over.
Changes to prices and to these terms
We won’t change the price of your plan during your minimum term. After that, we will give you at least 60 days’ notice of a price change by email. If you don’t want the new price, you can leave before it starts.
We may update these terms, for example when the law or our services change. We will email you at least 30 days before a change that affects you. If a change is to your disadvantage and you don’t accept it, you can end your plan before it takes effect, with nothing to pay for the remaining months of your minimum. A change never alters a price or a minimum term you have already agreed.
Each version has its own date at the top of this page, and your order records the version you agreed to.
General
Neither of us is responsible for delays caused by events outside our reasonable control, such as a major outage at a provider we rely on, or extreme weather. If this happens, we will tell you and do what we reasonably can.
We send notices by email to the address in your account. Please send yours to hello@leapr.co.uk. An email counts as received on the next working day after it is sent.
You can’t transfer your agreement to someone else without our written agreement. We may transfer it to a company that takes over our business, and we will tell you if we do.
If a court decides that part of these terms can’t be enforced, the rest still applies. If we don’t enforce a right straight away, we can still enforce it later.
No one else can enforce these terms, only you and Leapr Limited. These terms, your order and any proposal you accept are the whole agreement between us about our services.
Governing law
These terms and any dispute about them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
Before either of us goes to court, we both agree to try to sort out the problem by talking first.
Contact and complaints
If you have a question or a complaint, email us at hello@leapr.co.uk. We will reply as soon as we can and tell you what we will do about it.
If you’d like to talk anything through first, book a free consultancy call.
